Class Action

Sometimes a lot of people have been harmed by a similar cause, or the same person or organization.  When that happens, it may be in our client’s best interests to join together with other persons to bring a law suit.  When a group of individuals bring a lawsuit together, this is called a “class action”.

An example of a class action is a law suit against a manufacturer of artificial breast implants by persons that suffered similar harms to their health as a result of defects in the implants.  A few of the persons with a claim become representatives of all of the persons making a claim against that manufacturer.

When clients are involved in class actions, they are able to make a stronger case than they could if they were bringing individual law suits.  Some class actions get faster results, and because services are shared, legal fees are reduced for the group.

Over the years, we have worked on many successful class actions, especially against manufacturers of defective medical products and devices (for example, breast and jaw implants).  In addition, we have participated in leadership of the class action concerning the Walkerton victims of contaminated water.

Some class actions are national or international.  We have successfully represented clients who wish to join existing class actions.  In many cases, we have obtained very favourable awards.  Our team approach enables us to work with other law firms engaged in class actions and by that collaboration to achieve very favourable awards for our clients.

There are several other ways in which lawsuits can be brought together.  The class action is one of those ways.  Time, cost, and whether success is expected are all considered when we decide whether a group action is better than an individual action.

If you have suffered a loss as a result of another person or organization’s products, actions or failure to act, you may be entitled to a legal remedy or payment.  We invite you to speak with one of our lawyers to decide whether your have a case, and whether a class action may be best for you.
